General Terms of Use (GTC)

1. Scope and Provider

These terms of use govern the contractual relationship between the operator of Mallorca-Zero, Christian Donnert (hereinafter "Provider"), and the users (hereinafter "User") of the online platform. By registering or using the services, the User agrees to these terms.

2. Description of Services

Mallorca-Zero is a regional online marketplace that focuses exclusively on offers and requests related to the island of Mallorca. The Provider merely provides the technical platform on which Users can create and publish listings. Contracts initiated through these listings are concluded exclusively between the respective Users. The Provider will not be a contracting party to transactions concluded between Users.

3. Registration and User Account

  1. Use of certain functions (e.g., placing listings) requires registration. There is no legal entitlement to the conclusion of a user agreement.
  2. The User is obliged to provide truthful information and to keep their data up to date.
  3. Each User may create only one user account. The registration of multiple accounts is prohibited.
  4. Access data must be kept confidential and must not be passed on to third parties.

4. Principles for Placing Listings and Use of AI

  1. Regional relevance: Only listings that have a direct connection to Mallorca are permitted. Offers for real estate, jobs or services outside Mallorca are not allowed.
  2. AI optimization & translation: The Provider is entitled to automatically translate listing content (e.g., via DeepL/OpenAI) and to optimize it for search engines (SEO). The advertiser remains responsible for the factual accuracy of the content.
  3. Copyrights: The User warrants that they hold all rights to the published texts and images. The use of third-party photos (e.g., copied from the internet or stock photos) is prohibited.
  4. Automated verification (AI moderation): To ensure platform safety, youth protection and compliance with these terms of use, the Provider uses automated checking procedures and artificial intelligence (AI). These systems analyze listings upon publication and upon subsequent modifications for prohibited content.

5. Prohibited Content and Activities

It is forbidden to publish listings that violate legal provisions, the rights of third parties or public decency. In particular, the following content and actions are not permitted:

  • Broker solicitation: Commercial real estate and property acquisition by real estate agents or commercial intermediaries in the form of wanted requests. The real estate requests category is reserved exclusively for private end users to meet their own personal needs.
  • No Mallorca relevance: Listings, goods, services and job offers without a direct regional connection to the island of Mallorca. For job and service offers, the actual place of performance of the activity must be on Mallorca; job offers with a place of work outside Mallorca are not permitted.
  • Multiple listings: Posting identical or substantially equivalent listings (duplicates), including using different categories, user accounts or contact details, as well as artificially splitting a single offer into multiple individual listings.
  • Third-party listings: Placing listings on behalf of third parties (representative listings).
  • Unfair advertising & redirects: Pure advertising for external websites, e-commerce shops, auction portals or directories, as well as affiliate and commission links or pure purchase redirects to third-party platforms without direct own sale.
  • Multi-level marketing & dubious earning opportunities: Offers for network marketing (MLM), multi-level marketing, structural distribution systems, referral marketing and pyramid schemes. Furthermore, non-transparent job offers without stating the specific activity or corporate background, offers requiring upfront fees (e.g., for training or starter kits), and job postings with legally impermissible discriminatory criteria such as unfounded age limits.
  • Erotic content & youth protection: Offers, requests and depictions with erotic, pornographic or youth-endangering content. This includes in particular commercial erotic and escort services, prostitution, erotic massages, webcam services and adult content, as well as all job offers, castings or cooperation requests for activities in the erotic and adult sector. Contact initiation via anonymous free webmail services for such purposes is likewise prohibited.
  • Financial services & loans: Offers for private loans, credits without credit checks, dubious financial investments, as well as crypto trading systems or promises of rapid wealth accumulation.
  • Prohibited goods & unlawful items: Offering weapons, ammunition, narcotics, prescription medicines, stolen goods, as well as counterfeits and brand infringements. Likewise, offering animals in violation of applicable statutory animal welfare and registration regulations.
  • Gambling: Sweepstakes, betting offers of any kind including lotteries and other games of chance.
  • Poor quality & pricing practices: Insufficiently described offers, listings without description text of their own (e.g., mere references to photos or external links), obvious fantasy prices (price spam), and listings written entirely in capital letters (ALL-CAPS).
  • Abusive communication: Insults, discrimination, racist statements as well as public warnings, appeals or evaluations directed at other users or companies within the listing text.

6. Usage Rights and Indemnification

  1. By posting content, the User grants the Provider the right to make this content publicly accessible and to distribute it on the platform and in associated channels (e.g., social media).
  2. The User indemnifies the Provider against all claims made by third parties arising from the infringement of their rights by content posted by the User. This also includes the costs of necessary legal defense.

7. Changes to Listing Content and History

  1. The advertiser is entitled to change, supplement or delete the content of their listing at any time, provided the listing is still active.
  2. A change to the listing text after an agreement has already been reached between buyer and seller does not affect the validity of the contract already concluded. The operator does not intervene in disputes regarding subsequent text changes.
  3. The operator reserves the right to store versions of the listing internally (history) in order to be able to provide information in the event of justified suspicion of legal violations or upon official request. The User has no claim to the disclosure of this history.

8. Fees and Paid Services

  1. The basic use of Mallorca-Zero is free of charge.
  2. The User has the option to purchase paid additional services (e.g., highlighted listings) via the integrated shop.
  3. Conclusion of contract: A paid contract is only concluded when the User clicks the button “Order with obligation to pay” (or a similarly clear label) in the shop.
  4. Billing is processed via the offered payment service providers (e.g., Stripe, PayPal). The User will receive an invoice by e-mail or as a download.

9. Right of Withdrawal for Digital Services

  1. Consumers generally have a statutory right of withdrawal of fourteen days from the conclusion of the contract.
  2. Premature expiration: The right of withdrawal expires prematurely for contracts for digital services (e.g., the immediate activation of a listing highlight) if the Provider has fully performed the service and the performance of the service began only after the User expressly consented to this and simultaneously confirmed their awareness that they would lose their right of withdrawal upon the Provider's full performance of the contract.

10. Measures in Case of Violations and House Rules

  1. The Provider reserves the digital house right. In the event of violations of these terms of use (in particular point 5) or in case of justified suspicion of abuse, the Provider is entitled to reject, deactivate or delete listings in whole or in part without prior notice and to temporarily or permanently block user accounts. This also applies to rejections made by automated checking procedures (AI).
  2. There is no legal entitlement to the publication, activation or permanent provision of listings or the use of Mallorca-Zero. There is no entitlement to a manual case-by-case review or renewed justification for rejected listings.

11. Limitation of Liability

  1. The Provider gives no warranty for the accuracy, completeness or currency of content provided by Users.
  2. The Provider is not liable for the continuous availability of the website or for technical malfunctions beyond its control.
  3. For damages, the Provider is liable only in cases of intent or gross negligence.

12. Final Provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected. The Provider reserves the right to change these terms at any time. Changes will be notified to the User before they take effect.
